Frank Carney's areas of law practice include executive compensation and employee benefit plans, including pension and profit sharing plan formation, operation and administration, negotiations with the Department of Labor, Pension Benefit Guaranty Corporation, and Internal Revenue Service on pension plan issues. Mr. Carney's employee benefit plan practice includes governmental, tax exempt, and private for profit retirement plans, health and welfare benefit plans, nonqualified employee benefit plans, and employee fringe benefit plans. In connection with his work with health and welfare benefit plans, Mr. Carney also provides representation to governmental entities and service providers, such as actuaries, investment consultants, and administrators of health and welfare benefit plans with respect to other post-employment benefits (OPEB) and OPEB trusts under GASB 43/45 rules and the Tennessee OPEB Act. Mr. Carney provides federal, state and local tax representation, including tax refund claims, tax appeals, actions before administrative agencies and courts, tax audits, civil tax enforcement actions; tax planning and resolution of tax issues; tax exempt bond financing; estate planning and probate matters; and health care law. Mr. Carney has lectured on qualified defined benefit plans, defined contribution plans, governmental plans, 403b plans, OPEB, tax planning for wills and estates, trusts, legal drafting and constitutional law.
While working on his master's degree, Mr. Carney taught expository prose and composition at Baylor University. Following graduation, he taught Western World literature, expository prose and composition at Hong Kong College in Kowloon, Hong Kong.
Mr. Carney is a member of the American, Tennessee and Memphis Bar Associations, the Memphis Bar Association, American Society of Pension Professionals & Actuaries, National Association of Bond Lawyers, and the NHLA/AAHA American Health Lawyers Association. He is also a member of the National Association of Public Pension Attorneys.
