Gene Thornton focuses his practice in health care law with an emphasis on representing physician groups in health care regulations, technology, corporate and contractual relationships. He serves as corporate, transactional and regulatory counsel to entities providing services and products in areas such as single and multi-specialty physician practices, medical billing, hospitals, wholesale pharmacy, electronic patient communication, support for clinical trials, and health care non-profit foundations. He also assists clients in the creation of professional health care corporations and limited liability companies as well as Tennessee non-profit and tax exempt organizations.
Mr. Thornton helps clients protect and manage health information to comply with the Health Insurance Portability and Accountability Act (HIPAA), security breach notification requirements and other applicable state and federal privacy and security requirements (including the Red Flag Rules). He frequently counsels clients in their efforts to comply with the legal and regulatory requirements of the federal health program rules, the anti-kickback and physician self-referral (Stark) prohibitions and other fraud and abuse provisions. He counsels clients on the federal policy for the Protection of Human Subjects as well as numerous state corporate and privacy rules and regulations. He has also counseled governmental entities on HIPAA issues and other regulatory matters related to self-funded health plans.
Mr. Thornton's experience also includes corporate litigation matters, electronic records compliance, public school administrative and contractual matters, and federal and state statutory matters, including the Tennessee Charter Schools Act.
